§ 56-64. Imposition of correctional facilities impact fees.

(a)

All residential construction occurring within the county, both within the unincorporated area and within the municipal boundaries of any municipality that has consented to the imposition of the correctional facilities impact fee, shall pay the correctional facilities impact fee established in this article, at the time of issuance of a building permit for such residential construction.

All residential construction occurring within the county that submits a complete application for a building permit on or after January 1, 2009, shall not be required to pay the correctional facilities impact fees imposed by this section pursuant to section 56-142. The collection of correctional facilities impact fees shall resume upon expiration of the suspension period as provided in subsection 56-142(f) herein.
